These Terms and Conditions govern your use of the FWBP Academy website, online courses and educational resources.  By accessing our website, creating an account or purchasing a course, you agree to these Terms and Conditions, subject to any additional terms presented to you at the time of purchase and your rights under applicable consumer law.  Please read these Terms and Conditions carefully.  
1. ABOUT FWBP ACADEMY  FWBP Academy provides online Brazilian Portuguese language courses, lessons and supplementary educational materials.  The website is operated by Fernando Nonohay Language Services, trading as FWBP Academy.  
2. USE OF THE WEBSITE  You may use the FWBP Academy website and its educational resources for lawful, personal and non-commercial purposes.  You agree not to:  Use the website for unlawful activities. | Attempt to gain unauthorised access to the website or its systems. | Share your account login details with other individuals. | Copy, reproduce, distribute or resell course materials without permission. | Interfere with the operation or security of the website.  
FWBP Academy reserves the right to suspend or restrict access where a user seriously violates these Terms and Conditions, subject to applicable consumer law and existing contractual obligations.  
3. COURSE ENROLMENT AND ACCESS  When you purchase a course through FWBP Academy, you receive a personal, non-transferable licence to access and use the educational content included in your purchase.  Course content may include recorded video lessons, audio recordings, PDF documents, worksheets, exercises, vocabulary lists and other educational resources.  Access to courses is provided through the FWBP Academy website, hosted on New Zenler.  You are responsible for maintaining the confidentiality of your account login details.  You may not transfer your course enrolment to another person or share access to your account.  The duration and conditions of course access are determined by the terms and descriptions applicable at the time of purchase, together with any subsequent agreement between FWBP Academy and the student.  
4. IMPORTANT NOTICE: FWBP ACADEMY CLOSURE  FWBP Academy is undergoing a transition to a new teaching platform and learning community.  As part of this transition, the FWBP Academy website and its existing course platform are scheduled to close on 31 March 2027.  Students who have purchased courses through FWBP Academy will continue to have access to their existing courses through the current platform until 31 March 2027, subject to any additional rights arising from their original purchase agreements and applicable consumer law.  Following the closure, courses will no longer be accessible through the existing FWBP Academy website.  Students will receive advance notification of the closure by email, using the email address associated with their FWBP Academy account.  We encourage students to revisit their purchased courses and download any available educational resources they wish to retain before 31 March 2027.  
5. DOWNLOADABLE COURSE MATERIALS  Students may download any educational resources expressly made available for download within their purchased courses.  These resources may include:  PDF lesson notes and worksheets. | Audio recordings. | Vocabulary lists. | Grammar explanations and reference materials. | Supplementary exercises and learning resources. | Other downloadable content provided within individual courses.  Students may retain and use these downloaded materials for their own personal, non-commercial educational purposes, including after the closure of FWBP Academy.  All course materials remain the intellectual property of FWBP Academy and/or their respective copyright holders.  Downloading materials does not transfer copyright or ownership of the content to the student.  Downloaded materials may not be reproduced, redistributed, published, resold, uploaded to other websites or shared with third parties without prior written permission.  Streaming video lessons and other content not specifically made available for download may not be downloaded, recorded or reproduced without permission.  
6. COURSE CONTENT AND EDUCATIONAL PURPOSES  FWBP Academy aims to provide clear, accurate and useful Brazilian Portuguese language instruction.  Course content is designed for educational purposes and may include explanations of grammar, pronunciation, vocabulary, colloquial expressions and Brazilian culture.  Language usage varies according to region, social context, individual preference and other factors.  The explanations and examples provided in our courses reflect the educational approach and teaching experience of the course creator.  While every effort is made to ensure the quality and accuracy of our educational content, individual learning outcomes depend on factors including practice, consistency, previous knowledge and personal circumstances.  FWBP Academy does not guarantee that completing a course will result in a particular level of language proficiency or fluency.  Nothing in this section limits your statutory rights in relation to the quality, description or fitness for purpose of purchased digital content and services.  
7. PRICES AND PAYMENTS  Course prices are displayed on the relevant sales pages at the time of purchase.  Payment must be completed through the available payment methods before access to a paid course is granted, unless an alternative arrangement has been expressly agreed.  Where applicable, payment plans or instalment arrangements will be described at the time of purchase.  Customers are responsible for ensuring that the payment information they provide is accurate and up to date.  Any additional fees, taxes or charges will be disclosed as required by applicable law before a purchase is completed.  
8. REFUNDS AND CANCELLATIONS  Refund requests will be considered in accordance with the refund policy presented at the time of purchase and applicable consumer protection legislation.  Where a course is purchased online, customers may have statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.  For digital content supplied immediately after purchase, these rights may be affected where the customer has expressly consented to immediate access and acknowledged the circumstances in which the statutory cancellation right may be lost, in accordance with applicable law.  Where statutory cancellation rights apply, FWBP Academy will honour those rights.  Nothing in this refund policy excludes or restricts any statutory rights or remedies available to customers where digital content or educational services fail to meet applicable legal requirements.  Refund enquiries should be submitted using the contact details provided in these Terms and Conditions.  
9. INTELLECTUAL PROPERTY  All original course content, videos, audio recordings, worksheets, exercises, graphics, written materials, teaching resources and other educational content created by FWBP Academy are protected by copyright and other applicable intellectual property laws.  Unless otherwise stated, the intellectual property rights in original FWBP Academy materials belong to FWBP Academy or the respective rights holders.  Students are granted permission to use purchased course materials for their own personal educational purposes.  Without prior written permission, students may not:  Reproduce or redistribute course materials. | Share purchased course content with other individuals. | Upload course materials to websites, file-sharing services or social media platforms. | Sell or commercially exploit course content. | Present FWBP Academy materials as their own work. | Use course materials to create competing educational products. | Record or reproduce streaming lessons without permission.  Any permission granted to retain downloaded materials after the closure of FWBP Academy is limited to personal, non-commercial educational use.  
10. CHANGES TO COURSES AND SERVICES  FWBP Academy may update course materials, correct errors, improve lessons, revise educational content or introduce additional learning resources.  We may also make reasonable changes to the website or its technical functionality.  Where a proposed change would materially affect a purchased course or a student's contractual rights, we will provide appropriate information and notice in accordance with applicable law.  Any changes to purchased courses or access arrangements will remain subject to the terms applicable at the time of purchase and any subsequent agreement with the student.
 11. TRANSITION TO THE BRAZILIAN PORTUGUESE CLUB  FWBP Academy is transitioning to a new learning community called the Brazilian Portuguese Club, hosted on Skool.  The Brazilian Portuguese Club provides opportunities for learners to practice Brazilian Portuguese, connect with other learners and participate in educational activities.  Free community membership is available, alongside separate paid educational programmes and membership options.  The Brazilian Portuguese Club may offer:  New Brazilian Portuguese courses. | Educational eBooks and downloadable resources. | Exclusive learning materials. | Live group sessions. | Community discussions and learning activities. | Additional resources introduced as the membership develops.  Courses and educational resources offered through the Brazilian Portuguese Club are separate from those previously purchased through FWBP Academy unless expressly stated otherwise.  Previous purchases through FWBP Academy do not automatically include access to new courses or paid membership programmes offered through the Brazilian Portuguese Club.  Any new membership or course purchase will be subject to the relevant terms, conditions and pricing presented at the time of purchase.  Students interested in the new community can visit:  https://www.skool.com/fernandos-portuguese-club-9588/about 
12. THIRD-PARTY PLATFORMS AND WEBSITES  FWBP Academy uses third-party services to host courses, process payments and provide educational resources.  These services may include New Zenler, payment processors and other technology providers.  We may also provide links to external websites or educational resources that we believe may be useful to students.  External websites and platforms operate under their own terms, conditions and privacy policies.  FWBP Academy is not responsible for the independent content, practices or services of third-party websites that it does not control.  This provision does not exclude any responsibility FWBP Academy may have under applicable law for services it has agreed to provide.  
13. ACCOUNT SECURITY  Students are responsible for keeping their login details confidential and taking reasonable steps to protect their accounts.  If you believe your account has been accessed without permission, please contact FWBP Academy.  We may take reasonable steps to protect the security of the website and its users, including temporarily restricting access where necessary.  Any such action will be proportionate to the circumstances and subject to applicable contractual and statutory obligations.  
14. WEBSITE AVAILABILITY  FWBP Academy aims to maintain reliable access to its website and educational content during the period in which its courses are available.  However, temporary interruptions may occasionally occur because of technical maintenance, software updates, internet connectivity or circumstances outside our reasonable control.  We will make reasonable efforts to resolve technical problems affecting course access.  Where a significant interruption affects a purchased course, students may contact FWBP Academy for assistance.  Nothing in this section excludes or restricts any rights or remedies that may arise where FWBP Academy fails to fulfil its contractual obligations.  
15. PRIVACY AND PERSONAL INFORMATION  FWBP Academy respects the privacy of its students and website visitors.  Personal information may be collected and processed for purposes including:  Creating and managing student accounts. | Processing course purchases. | Providing access to educational content. | Responding to customer enquiries. | Communicating important information about purchased courses. | Providing updates about changes to the FWBP Academy platform. | Sending marketing communications where permitted by applicable law.  Personal information will be handled in accordance with applicable data protection legislation and our Privacy Policy.  Students may contact FWBP Academy with questions about their personal information or to exercise applicable data protection rights.  Marketing communications may be unsubscribed from using the relevant unsubscribe link or by contacting FWBP Academy.  
16. LIMITATION OF LIABILITY  FWBP Academy does not guarantee uninterrupted access to its website or that its services will be entirely free from technical errors.  We will, however, take reasonable steps to provide the educational content and services described at the time of purchase.  Nothing in these Terms and Conditions excludes or restricts liability where doing so would be unlawful.  In particular, nothing excludes or restricts liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any statutory rights and remedies that cannot lawfully be excluded or restricted.  
17. TERMINATION OF ACCOUNT ACCESS  FWBP Academy may suspend or terminate an account where a student seriously breaches these Terms and Conditions, including through unauthorised distribution of course materials, fraudulent activity or deliberate interference with the website.  Where appropriate, we will provide an explanation and a reasonable opportunity to resolve the issue before terminating access.  Account suspension or termination will be proportionate to the circumstances and subject to applicable contractual and statutory rights.  The scheduled closure of the FWBP Academy website on 1 May 2027 is addressed separately in Section 4 of these Terms and Conditions.  
18. CHANGES TO THESE TERMS AND CONDITIONS  FWBP Academy may update these Terms and Conditions to reflect changes in its services, business operations, legal requirements or teaching platforms.  The latest version will be published on the FWBP Academy website with an updated effective date.  Where changes materially affect existing customers, appropriate notice will be provided.  Changes to these Terms and Conditions will not retrospectively remove or restrict contractual rights arising from earlier purchases unless a lawful and valid agreement to the relevant change has been reached.  
19. GOVERNING LAW  These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protection laws that apply in the customer's country of residence.  Nothing in these Terms and Conditions limits a consumer's right to rely on applicable mandatory legal protections or to bring proceedings in a court that has jurisdiction under applicable law.
